Kennedy convicted of murder in 2018 Raceway shooting

One of four men who were charged with a shooting at the Raceway gas station on Highland Avenue in 2018 was convicted last week.

According to a press release from District Attorney Robert Turner, Darryl Kennedy was convicted on Friday, March 7, by a Dallas County jury on several charges, including murder, two counts of second-degree assault and discharging a firearm into an occupied vehicle. After deliberating for just over an hour, the jury returned a guilty verdict on all counts.

The conviction stems from a 3 a.m. incident on April 28, 2018, in which Earnest Weaver Daniel III was shot and killed and Martavis Aaron and Marquavious Benjamin were both injured at the Raceway Gas Station on Highland Avenue.

Kennedy and Jimmie Lee Tyus, another suspect in the case, were arrested in August 2018 in Spring Hill, Florida. Tyus was convicted last year on charges of murder, including two counts of first-degree assault and shooting into-an occupied vehicle.

The trial, presided over by Circuit Judge Marvin Wiggins, concluded with the jury’s verdict. A sentencing hearing will be scheduled at a later date.

Kennedy faces a sentence ranging from 10 to 99 years, or life, in prison for the murder charge. He also faces a potential sentence of one to 10 years for the second-degree assault charges and two to 20 years for the charge of discharging a firearm into an occupied vehicle.

The case was prosecuted by Assistant District Attorneys Leif Hampton, Shamika Dudley and Bryan Jones.
