Alabama delegation divided on vote to revoke Trump’s national emergency declaration

A resolution co-sponsored by Rep. Terri Sewell, D-AL, cleared the U.S. House of Representatives Tuesday with the support of more than 200 legislators.

The resolution, filed on Friday, is a statement of disapproval for President Donald Trump’s decision to declare a national emergency in order to free up government funds to pay for his proposed wall along the U.S.-Mexico border.

After clearing the House, the measure must go before the U.S. Senate within 18 days, though it is unlikely that the measure will garner enough support to avoid the president’s veto pen.

“The President’s emergency declaration is an overreach of executive power,” Sewell said. “He himself said he did not ‘need to’ declare an emergency at the border.”

Though she and other House members have questioned the constitutionality and legality of the president’s actions, Sewell insists there are more immediate emergencies that need to be addressed.

“The real national emergency is not at our southern border – it is in our rural areas where hospitals are struggling to keep their doors open; it is in Lowndes and Wilcox counties, where residents lack basic water resources; it is in communities across the country that continue to be devastated by the opioid crisis,” Sewell said. “President Trump’s border wall is not a national emergency.”

For her part, Rep. Martha Roby, R-AL, disagrees.

“Any presidential administration has certain authorities to take executive actions,” Roby said. “At this time, I do not believe it is appropriate for Congress to revoke and dismantle this authority. As a member of the House Appropriations Committee, I will continue to take very seriously our constitutional responsibility to fund the government, including making available resources to secure our southern border.”

Sen. Doug Jones, D-AL, stated that he will back the resolution once it makes its way to the U.S. Senate.

Representatives for Sen. Richard Shelby, R-AL, did not respond to a request for comment.
