State rests in murder trial

A former girlfriend of Tyrone Stallworth said she was with him at least an hour before he was supposed to have shot and killed Clinton Peeples Jr.

Brittney King testified Tuesday she was with Stallworth at his mother’s house and they watched television.

“He was sick,” she told the jury. “He had a stomach virus.”

Stallworth is accused of murder in the Jan. 27, 2004, shooting death of Clinton James Peeples Jr. outside a Voeglin Avenue residence.

King, of Montgomery, said she dated Stallworth at the time, but they had broken up and she had not seen him in years.

King was the first witness for the defense. Others are expected to shore up that testimony for the defense.

Defense attorney Bruce Maddox has said nobody saw his client shoot Peeples that night.

The prosecution ended its case by presenting several witnesses who testified to the shooting, including an evidence technician from the Selma Police Department, who picked up 18 nine millimeter casings and two high-power rifle casings from in front of the house.

The same evidence technician, Clarissa Cole, also testified Peeples carried a .40-caliber handgun, which was never fired in the shooting.
