After learning that the accused, Anthony E. Oliver, a native of Dallas County who now resides at 419 38th St. in Tuscaloosa, was a two-time convicted felon and has charges pending, Walker sent him back where he was before making the initial $15,000 bond for the first-degree assault charge &045;&045; the Dallas County Jail.
An emotionless Oliver sat in a designated area for detainees with a new bond set at $35,000.
It was Aug. 5 of this year when 35-year-old Oliver and an associate allegedly stopped the victim, Joseph Agee, who was on his way home from Food World.
Agee testified that after parking his truck he began to unload groceries and was punched in the face by Oliver.
Unable to react with the groceries in hand, Agee said he was then struck repeatedly by Oliver’s fist.
Agee said Oliver then took a wooden cane and began to hit him until it broke. He said Oliver then began beating him with a 3-foot long iron pipe.
Agee said he attempted to get away by running to a neighbors house for help and to tell them to call the police. Agee said Oliver was still swinging the iron object, and struck the neighbor’s car.
In an attempt to elude Oliver, Agee went back to his vehicle and Oliver followed, still swinging the pipe, and damaged his truck too.
Eventually, Agee pulled-off and headed to a nearby gas station, where he told the attendant to call his sister and tell her to meet him at the hospital.
Agee was transported to University of Alabama in Birmingham Hospital and remained there for three days after receiving stitches for the deep laceration inflicted on the head and rib areas.
Agee testified he never tried to fight back, a claim which Oliver denied.
Oliver has previous convictions for third-degree burglary, third-degree robbery, has had multiple arrests and a sexual abuse charge that is still pending.
He will remain at the county jail until the remainder of the new bond is posted.
