Three juveniles wait for day in court

Published Wednesday, July 23, 2008

Three juveniles arrested for the recent assault of J.P. Lee, 60, remain in the Dallas County Detention Center.

The teens went before the County Court to set a court date.

District Attorney Michael Jackson filed for a motion for continuation.

“We want to see how the situation with the victim is after the set Aug. 5 date,” Jackson said. “We want to apply the strongest charges that fit the crime.”

The three juveniles will remain in the Dallas County Detention Center until they are called before the juvenile judge.

The three juveniles are accused of assaulting Lee at Taylor’s Restaurant, Cecil Jackson Bypass, July 15.

Three males attacked Lee in the screened back area of the restaurant, police said.

A family member, who did not want to be identified, said Lee suffered broken ribs and a head injury.

Lee is at Jackson Hospital in Montgomery according to the family member.

Lee’s condition is still balancing at an important point.

“As I understand it, he is still in critical condition,” Jackson said. “If something happens and he does not pull through, then we will apply murder charges.”

Under Alabama law, if a juvenile 16 or older commits a Class-A felony, then the teenager is automatically tried as adult.

Jackson said two of the three juveniles are at least 16 and the other is 15.

“I will try to certify the 15-year-old as an adult if it becomes necessary,” Jackson said.
